Rent Agreement Kyun Zaroori Hai?
Rent agreement ek qanooni contract hai jo landlord aur tenant ke darmiyan hota hai. Iske bina court mein case karna mushkil ho jata hai, kiraya band hone par koi saboot nahi hota, security deposit dobara milne ka koi zaamin nahi hota, makaan khali karane par mushkil hoti hai, aur NADRA, police, ya bank ke kamon mein problem aati hai. Pakistan mein Rent Restriction Ordinance 2001 ke tahat rent agreement ka hona zaroori hai.
Rent Agreement Ki Zaroori Shartein
Ek complete rent agreement mein Parties Ki Malumat: landlord aur tenant ka poora naam, CNIC, aur address hona chahiye. Property Ki Tafseel mein poora address, floor, size, number of rooms likha jaye. Kiraya Ki Raqam mein monthly rent aur payment date, Duration mein kitne arsa ke liye contract hai, Security Deposit ki raqam aur wapsi ki shartein, Utilities mein bijli, gas, paani bill kaun ada karega, aur Notice Period mein makaan khali karne se pehle kitne din pehle batana hoga clearly likha hona chahiye.
Rent Agreement Banane Ka Tarika
Pehle LegalDocs.pk se apni zaroorat ke mutabiq template download karein. Dono parties ki CNIC copies saath rakhein aur sari details carefully bharein. Rent agreement Rs. 100 se Rs. 500 ke non-judicial stamp paper par banana chahiye. Contract par do gawahaan ke dastakhat hone chahiye. Agar aap rent agreement ko Sub-Registrar office mein register karwa lein toh yeh aur bhi mazboot ho jata hai. Dono parties ko original ya certified copy rakhni chahiye.
Kiraya Badhaane Ka Qanoon
Pakistan mein Rent Restriction Laws ke mutabiq landlord apni marzi se kiraya nahi badha sakta. Urban areas mein Rent Controller se permission leni padti hai. Agreement mein agar increment clause ho toh woh valid hota hai maslan har saal 10% badhega. Aapke rent agreement mein yeh clause zaroor shamil karein taki baad mein jhagra na ho.
Tenant Ke Huqooq
Tenant ke yeh huqooq hote hain: makaan peaceful use karne ka haq, security deposit wapas milne ka haq, bilawaja nikaale jane se protection, repair aur maintenance ki demand, aur receipt lene ka haq. Landlord bina notice ke makaan mein nahi aa sakta. Agar landlord yeh huqooq violate kare toh tenant Rent Controller se raabta kar sakta hai.
