Property Sale Agreement in Pakistan — Checklist and Free Template
Pakistan mein property khareedna ek bara decision hai — aur agar agreement sahi nahi bani, toh mushkilein puri zindagi tak peeche nahi chhorti.
Property Sale Agreement Kya Hoti Hai?
Jab bhi koi zameen, plot, makan ya flat khareedne ya bechne ka irada ho, toh sabse pehla aur sabse zaroori step hota hai ek Sale Agreement banana. Ise Urdu mein بیعنامہ bhi kehte hain.
Yeh document buyer aur seller ke darmiyan ek written promise hoti hai — jisme likha hota hai ke kitni raqam mein property bik rahi hai, kab payment hogi, kab possession milegi, aur agar koi ek party mukar jaye toh kya hoga.
Bohot log sochte hain ke yeh bas ek formality hai. Lekin sach yeh hai ke Pakistan mein property disputes mein se zyada tar cases wahan se shuru hote hain jahan agreement ya toh bani hi nahi, ya galat bani.
Sale Agreement Aur Sale Deed Mein Farq Kya Hai?
Yeh confusion almost har doosre buyer ko hoti hai, toh ise simple rakhte hain.
Sale Agreement ek promise hai. Isme likha hota hai ke "hum agree karte hain ke yeh property itni raqam mein bechni hai, yeh terms par." Lekin is stage par property ka title transfer nahi hota. Ownership abhi bhi seller ke paas hoti hai.
Sale Deed — yani Registry — woh final document hai jis par Sub-Registrar ke saamne sign hote hain aur property ka legal title buyer ke naam transfer hota hai. Bina registered Sale Deed ke, aap sirf kaghaz par buyer hain, law ki nazar mein nahi.
Sale Agreement aur Sale Deed ke darmiyan ka waqt generally tab kaam aata hai jab remaining payment process ho rahi ho, NOCs collect ho rahay hon, ya bank se loan approve hone ka wait ho.
Yeh Agreement Kyun Zaroori Hai?
Aaj ke Pakistan mein property fraud bohot common ho gaya hai. Ek hi plot teen logon ko becha jaata hai. Kabhi seller baad mein muk'ar jaata hai, kabhi buyer paise dene ke baad ghayab ho jaata hai. Aise cases mein court mein jaana hi parta hai — aur agar koi written agreement na ho, toh court bhi zyada kuch nahi kar sakti.

- Aapke token aur advance ko protect karta hai
- Dono parties ke rights clearly define karta hai
- Possession aur payment ki dates legally fix kar deta hai
- Fraud aur dhokhe se bachane mein madadgar hoti hai

Property Sale Agreement — Complete Checklist
Jab bhi koi property agreement sign karo, yeh checklist zaroor check karo. Ek bhi point miss hua toh future mein masla ho sakta hai.
1. Parties Ki Sahi Details
Sabse pehli baat — buyer aur seller dono ka naam bilkul wैसा hona chahiye jaisa unke CNIC par likha hai. Ek letter ka farq bhi baad mein legal problem ban sakta hai.
Agreement mein yeh sab clearly likha hona chahiye:
- Buyer ka full name (CNIC ke mutabiq)
- Seller ka full name (CNIC ke mutabiq)
- Dono ke CNIC numbers
- Dono ke permanent addresses
- Contact numbers
Agar seller ki taraf se koi agent ya wakeel kaam kar raha hai, toh us ka Power of Attorney original dekhna zaroor verify karo. Kabhi kabhi fake POA se bhi fraud hoti hai.
2. Property Ki Mukammal Tafseelat
Agreement mein property ki itni detail honi chahiye ke koi bhi confuse na ho ke exactly kaun si property ki baat ho rahi hai.
- Plot/House number
- Street number ya naam
- Mohalla, sector ya colony ka naam
- City aur tehsil
- Agar agricultural zameen hai toh Khasra number aur Khatooni number
- Property ka total area — marla, kanal ya square feet mein — numbers aur words dono mein
- Charo taraf ki boundaries — North, South, East, West
Boundaries especially important hain kyunki Pakistan mein plot disputes mein boundary ka masla sabse zyada aata hai.
3. Payment Ki Poori Detail
Paise ka hisab agreement mein crystal clear hona chahiye. Verbally kuch bhi keh lena kisi kaam nahi aata.
- Total agreed sale price — figures aur words mein
- Token ya earnest money ki amount
- Token kab diya gaya aur kaise (cash/cheque/bank transfer)
- Remaining amount ki payment schedule
- Har installment ki exact date aur amount
- Final payment ki deadline
- Registry kab hogi
Agar payment cheque se ho rahi hai toh cheque number bhi agreement mein note kar lo. Bank transfer se payment karna sabse safe hai kyunki us ka record hota hai.
4. Title Aur Ownership Ki Verification
Agreement sign karne se pehle yeh zaroor check karo:
Fard (فرد): Patwari ya PLRA se property ki latest ownership record nikalo. Isme confirm ho jaata hai ke property actually seller ke naam par hai ya nahi.
Encumbrance Check: Ensure karo ke property par koi bank loan, mortgage, court stay order ya kisi aur party ka haq nahi hai. Yeh Sub-Registrar office se check ho sakta hai.
Inheritance Cases: Agar property kisi ke marne ke baad aayi hai, toh verify karo ke tamam legal heirs ne apni marzi se bechne ki written permission di hai. Agar koi ek bhi heir missing hai, toh future mein deal invalid ho sakti hai.
Society ya Authority NOC: Agar property kisi housing society ya DHA/LDA type authority mein hai, toh society se No Objection Certificate lena zaroori hota hai.
5. Possession Kab Milegi
Yeh clause aksar ignore kiya jaata hai aur baad mein sabse zyada jhagra isi par hota hai.
Agreement mein clearly likho:
- Possession ki exact date ya condition (jaise "final payment ke 7 din baad")
- Kya property khali hogi ya koi tenant hai
- Agar tenant hai toh use kab tak nikala jaayega
- Property ki handover ke waqt utilities (bijli, gas, paani) ka kya hoga
6. Bills Aur Dues Ka Hisab
Possession se pehle ke tamam bills seller ki zimmedari hote hain. Yeh bhi agreement mein likha hona chahiye:
- Electricity bills ka settlement
- Gas (SNGPL/SSGC) bills ka settlement
- WASA ya local water supply ke dues
- Property tax aur municipal dues
- Koi bhi pending society charges
Agar yeh sab clear nahi kiya gaya toh buyer ke upar yeh sab aa jaata hai — aur seller mil bhi nahi raha hota.
7. Default Aur Cancellation Ka Clause
Zindagi mein kuch bhi ho sakta hai. Toh agreement mein clearly likha hona chahiye ke agar deal cancel hui toh kya hoga.
Agar seller mukar jaye: Pakistan mein standard practice yeh hai ke seller ko buyer ko token ki double raqam wapas karni padti hai. Yani agar token 5 lakh tha toh seller 10 lakh dega. Yeh deterrent hota hai frivolous cancellation se bachne ka.
Agar buyer mukar jaye: Token amount forfeit ho jaata hai — yani seller woh raqam rakh leta hai. Remaining payment mein delay ke liye bhi penalty clause add kar sakte ho.
Dispute Resolution: Yeh bhi likh do ke agar koi dispute aaye toh kaunse court ka jurisdiction hoga. Agar dono parties chahen toh pehle mediation ya arbitration ka option bhi add kar sakte hain — yeh faster aur cheaper hota hai court ke comparison mein.

Yeh basic template hai. Apni situation ke mutabiq modify karo aur kisi property lawyer se review zaroor karwao — khaaskar agar amount zyada ho.

POSSESSION: Physical possession of the property shall be handed over to the Buyer on __________ upon receipt of full and final payment.
SELLER'S WARRANTIES: The Seller hereby declares that:
- The Seller is the lawful owner of the above-mentioned property.
- The property is free from all encumbrances, mortgages, loans, court orders, and third-party claims.
- All dues, taxes, utility bills, and society charges up to the date of possession shall be cleared by the Seller.
DEFAULT CLAUSE:
- If the Seller fails to complete the sale, the Seller shall refund double the token amount to the Buyer.
- If the Buyer fails to make payment as per the agreed schedule, the token amount shall stand forfeited in favour of the Seller.
JURISDICTION: Any dispute arising from this Agreement shall be subject to the jurisdiction of courts in __________ (City).

Kuch Aur Important Baatein
Agreement stamp paper par likwao. Sada kaghaz par likha agreement legally kamzor hota hai. Kam az kam Rs. 100 ya Rs. 500 ka stamp paper use karo. Yeh kisi bhi stationery shop par mil jaata hai.
Har page par initials lao. Agar agreement multiple pages ki hai toh dono parties ke initials har page par hone chahiye — taake baad mein koi page replace na kar sake.
Apne paas copy rakhna. Dono parties ko agreement ki ek ek copy milni chahiye. Agar possible ho toh notarized copy banwao.
Paise transfer ka record rakhna. Jab bhi koi payment karo, koshish karo ke cheque ya bank transfer se ho. Cash dene ke baad seller se likhi hui receipt lena bilkul mat bhoolo.
Lawyer se review zaroor karwao. Yeh template starting point hai. Har property deal alag hoti hai — location, ownership history, amount, aur parties ke hisaab se clauses change hote hain. Ek baar lawyer ko dikha do, khaaskar agar raqam 20-30 lakh se upar ho. Yeh ek baar ka kharch kaafi problems se bacha sakta hai.
Aakhri Baat
Pakistan mein property khareedna ya bechna ek bara step hai — financially bhi aur emotionally bhi. Zyada tar log zindagi mein ek ya do baar hi yeh karte hain. Isi liye is mein jaldi nahi karni chahiye.
Agreement sign karne se pehle har clause parho. Agar koi baat samajh na aaye toh poochho — yeh aapka haq hai. Aur agar koi party keh rahi ho ke "arre yaar itni formalities ki kya zaroorat hai, trust karo" — yeh actually red flag hai.
